Use License
Permission is granted to temporarily access the materials on Krillan's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose or public display; attempt to reverse engineer any software contained on the website; remove any copyright or proprietary notations from the materials; or transfer the materials to another person. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Krillan at any time.
Disclaimers
The materials on Krillan's website are provided on an "as is" basis. Krillan makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Krillan does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Quotation Validity
All quotations provided by Krillan are valid for a period of thirty (30) days from the date of issuance, unless otherwise stated in writing. After this period, Krillan reserves the right to adjust pricing based on current material costs, labor rates, and availability. Quotes are based on the specifications provided at the time of the estimate; changes to design, quantity, garment type, or other specifications may result in revised pricing.
Order Cancellation
Orders may be cancelled without penalty prior to the commencement of production. Once production has begun (including but not limited to screen creation, digitizing, garment ordering, or material procurement), the customer is responsible for all costs incurred up to the point of cancellation. Custom or special-order materials that have been ordered are non-refundable. Krillan will make reasonable efforts to notify customers before beginning production on orders where cancellation has been requested.
Artwork Specifications
The customer is responsible for providing artwork that meets Krillan's production specifications. Preferred file formats include AI, EPS, PDF, PSD, TIF, and high-resolution JPEG. All fonts must be converted to outlines, and files should be saved at 300 dpi at actual print size. Krillan is not responsible for quality issues arising from low-resolution, improperly formatted, or incomplete artwork files. Additional charges may apply for artwork that requires extensive modification, recreation, or design services.
Proof Approval
A digital proof will be provided for customer approval prior to production on all orders. The customer is responsible for reviewing the proof carefully for accuracy of text, spelling, design placement, colors, and sizing. Once the customer provides written approval of the proof (via email or other documented communication), Krillan is not liable for errors present in the approved proof. Changes requested after proof approval may incur additional charges and production delays.
Color Proofing Tolerance
Colors displayed on screen may differ from the final printed product due to differences in monitor calibration, ink formulation, garment material, and printing processes. Krillan strives for the closest possible color match but cannot guarantee exact color reproduction. If specific Pantone (PMS) colors are required, they must be specified at the time of order. Slight variations in color between production runs are normal and should be expected, particularly across different garment types or materials.
Overrun and Underrun
Krillan reserves the right to deliver and bill for up to ten percent (10%) over or under the ordered quantity. This industry-standard tolerance accounts for variations in the production process, including but not limited to garment defects, misprints, and material inconsistencies. The customer agrees to accept delivery and pay for the actual quantity produced within this tolerance range.
Customer Property
Any customer-supplied materials, including but not limited to garments, blanks, substrates, and artwork, are held at the customer's risk. Krillan will exercise reasonable care in handling customer property but is not liable for loss or damage beyond the replacement cost of the materials. Customer-supplied garments should include a reasonable overage (typically 2-5%) to account for potential production losses. Krillan is not responsible for defects in customer-supplied materials.
Delivery
All orders are shipped FOB (Free On Board) from Krillan's facility in Sartell, Minnesota. Risk of loss transfers to the customer upon delivery to the carrier. Shipping costs are the responsibility of the customer unless otherwise agreed in writing. Krillan is not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control. Local pickup is available during regular business hours.
Returns Policy
Due to the custom nature of our products, returns are accepted only for defective merchandise. Claims for defective products must be made within seven (7) business days of delivery. The customer must provide photos and a description of the defect. Krillan will, at its sole discretion, reprint the defective items, issue a credit, or provide a refund for the defective portion of the order. Returns are not accepted for buyer's remorse, color variations within normal tolerances, or issues arising from customer-approved proofs.
Production Schedules
Production timelines are estimates and are subject to change based on order volume, complexity, material availability, and other factors. Standard production time is typically 10-14 business days from proof approval, though rush services may be available for an additional fee. Krillan will make every reasonable effort to meet agreed-upon deadlines but is not liable for delays caused by circumstances beyond our control, including but not limited to supplier delays, equipment malfunction, or force majeure events.
Payment Terms and Deposit
A deposit of fifty percent (50%) of the total order amount is required in advance before production begins, unless credit terms have been established in writing. The remaining balance is due upon completion, prior to delivery or shipment. Accepted payment methods include credit card, check, and electronic transfer. Accounts past due by more than thirty (30) days may be subject to a late fee of 1.5% per month. Krillan reserves the right to withhold delivery of completed orders until full payment is received.
Warranty Disclaimers
Krillan warrants that all work will be performed in a professional and workmanlike manner consistent with industry standards. This warranty does not cover normal wear and tear, damage resulting from improper care (failure to follow washing instructions), misuse, or alterations made after delivery. Krillan's liability is limited to the value of the defective goods and does not extend to consequential, incidental, or special damages. No warranty is provided for customer-supplied materials or for results achieved on materials not recommended by Krillan.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Minnesota, and you irrevocably submit to the exclusive jurisdiction of the courts in Stearns County, Minnesota. Any disputes arising from or related to orders placed with Krillan shall be resolved in the appropriate courts of the State of Minnesota. If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
